A non-citizen who is seeking to become a legal permanent residence here in the United States does so 
making an application to Adjust Statue to Legal Permanent Residence.  The non-citizen in removal 
proceedings may make this application to the Immigration Court.  The requirements are that the non-
citizen be physically present in the U.Ss., be the beneficiary of an approved visa petition granting family 
based immediate relative petition or a beneficiary or approved family or employment preference petition 
with a current priority date (or entitled to special immigrant status or under special legislation); and be 
admissible and not removable. 

Many applicants in removal proceedings are inadmissible, accordingly, in many situations, it is necessary 
to assess whether a waiver is available for the non-citizen.  There are sometime ways for a legal 
permanent resident to seek re-adjustment.  Each factual scenario has its own nuances and an individual 
should consult with immigration litigation experience.
